Customs bonding of non-EU registered yachts

If you are a EU resident then your car or boat has to be registered in your member state of fiscal domicile. It is against the law for a EU resident to own a non-EU registered boat or car.

A non-EU resident is allowed to spend up to six months in any 12 month period within the EU with tourist status. Once the non-EU resident spends 184 days (i.e. six months and one day, or the majority of a 12 month period) in the EU he or she technically becomes a resident and so any car or boat owned by that person should be EU registered and EU tax paid.

In order to prove that the owner of a non-EU vessel has not spent more than 183 days in the EU, each time the owner leaves the territory his boat or car should be bonded with customs and then unbonded whenever he returns to the EU. The total amount of time the vessel is in use in EU waters should not exceed 183 days.

The bonding procedure is merely a documentary one and the crew may remain on board throughout and carry out maintenance.
